TheHazardousWastes(ManagementandHandling)Rules,1989(asamended,May,2003)1.Shorttitleandcommencement(1)TheserulesmaybecalledtheHazardousWastes(ManagementandHandling)Rules,1989,asamendedinJanuary6,2000andMay21,2003.(2)TheyshallcomeintoforceonthedateoftheirpublicationintheOfficialGazette.2.ApplicationTheserulesshallapplytothehandlingofhazardouswastesasspecifiedinSchedulesandshallnotapplyto-(a)wastewaterandexhaustgasesascoveredundertheprovisionsoftheWater(PreventionandControlofPollution)Act.1974(6of1974)andtheAir(PreventionandControlofPollution)Act,1981(14of1981)andrulesmadethereunder;(b)wastesarisingoutoftheoperationfromshipsbeyondfivekilometersascoveredundertheprovisionsoftheMerchantShippingAct,1958(44of1958)andtherulesmadethereunder.(c)radio-activewastesascoveredundertheprovisionsoftheAtomicEnergyAct,1962(33of1962)andrulesmadethereunder.(d)bio-medicalwastescoveredundertheBio-MedicalWastes(ManagementandHandling)Rules,1998madeundertheAct;(e)wastescoveredundertheMunicipalSolidWastes(ManagementandHandling)Rules,2000madeundertheAct;and(f)theleadacidbatteriescoveredundertheBatteries(ManagementandHandling)Rules,2001,madeundertheAct.3.DefinitionsIntheserules,unlessthecontextotherwiserequires:-(1)"Act"meanstheEnvironment(Protection)Act,1986(29of1986);(2)"applicant"meansapersonoranorganisationthatapplies,inForm1,forgrantingofauthorisationtoperformspecificactivitiesconnectedwithhandlingofhazardouswastes;(3)"auction"meansbulksaleofwastesbyinvitationoftendersorauction,contractornegotiationbyindividual(s),companiesorGovernmentdepartments;(4)"auctioneer"meansapersonoranorganisationthatauctionswastes;(5)"authorisation"meanspermissionforcolection,transport,treatment,reception,storageanddisposalofhazardouswastes,grantedbythecompetentauthorityinForm-2;(6)"authorisedperson"meansapersonoranorganisationauthorisedbythecompetentauthority;(7)"CentralPollutionControlBoard"meanstheCentralBoardconstitutedundersub-section(1)ofsection3ofWater(PreventionandControlofPollution)Act,1974(6of1974);(8)"dispoal"meansdeposit,treatment,recyclingandrecoveryofanyhazardouswastes;(9)"export"meanswithitsgrammaticalvariationsandcognateexpressions,meanstakingoutofIndiatoaplaceoutsideIndia;(10)"exporter"meansanypersonunderthejurisdictionoftheexportingcountrywhoexportshazardouswastesandtheexportingcountryitself,whoexportshazardouswastsetoIndia;(11)"environmentallysoundmanagementofhazardouswastes"meanstakingallstepsrequiredtoensurethatthehazardouswastesaremanagedinamannerwhichwillprotecthealthandtheenvironmentagainsttheadverseeffectswhichmayresultfromsuchwastes;(12)"facility"meansanylocationwhereintheprocessesincidentaltothewastegeneration,collection,reception,treatment,storageanddisposalarecarriedout;(13)"form"meansaFormappendedtotheserules;(14)"hazardouswaste"meansanywastewhichbyreasonofanyofitsphysical,chemical,reactive,toxic,flammable,explosiveorcorrosivecharacteristicscausesdangerorislikelytocausedangertohealthorenvironment,whetheraloneorwhenincontactwithotherwastesorsubstances,andshallinclude-(a)wasteslistedincloumn(3)ofSchedule-1;(b)wasteshavingconstituentslistedinSchedule-2oftheirconcentrationisequaltoormorethanthelimitindicatedinthesaidSchedule;and(c)wasteslistedinLists'A'and'B'ofSchedule-3(Part-A)applicableonlyincase(s)ofimportorexportofhazardouswastesinaccordancewithrules12,13and14iftheypossessanyofthehazardou...
