2229CFRCh.XVII(7–1–10Edition)§1926.20107oftheAct,theprimecontractoras-sumesallobligationsprescribedasem-ployerobligationsunderthestandardscontainedinthispart,whetherornothesubcontractsanypartofthework.(c)Totheextentthatasubcon-tractorofanytieragreestoperformanypartofthecontract,healsoas-sumesresponsibilityforcomplyingwiththestandardsinthispartwithre-specttothatpart.Thus,theprimecontractorassumestheentireresponsi-bilityunderthecontractandthesub-contractorassumesresponsibilitywithrespecttohisportionofthework.Withrespecttosubcontractedwork,theprimecontractorandanysubcon-tractororsubcontractorsshallbedeemedtohavejointresponsibility.(d)Wherejointresponsibilityexists,boththeprimecontractorandhissub-contractororsubcontractors,regard-lessoftier,shallbeconsideredsubjecttotheenforcementprovisionsoftheAct.SubpartC—GeneralSafetyandHealthProvisionsAUTHORITY:Sec.3704,ContractWorkHoursandSafetyStandardsAct(40U.S.C.333);secs.4,6,and8,OccupationalSafetyandHealthActof1970(29U.S.C.653,655,657);SecretaryofLabor’sOrderNo.12–71(36FR8754),8–76(41FR25059),9–83(48FR35736),6–96(62FR111),or5–2007(72FR31160)asappli-cable;and29CFRpart1911.§1926.20Generalsafetyandhealthprovisions.(a)Contractorrequirements.(1)Sec-tion107oftheActrequiresthatitshallbeaconditionofeachcontractwhichisenteredintounderlegislationsubjecttoReorganizationPlanNumber14of1950(64Stat.1267),asdefinedin§1926.12,andisforconstruction,alter-ation,and/orrepair,includingpaintinganddecorating,thatnocontractororsubcontractorforanypartofthecon-tractworkshallrequireanylaborerormechanicemployedintheperformanceofthecontracttoworkinsur-roundingsorunderworkingconditionswhichareunsanitary,hazardous,ordangeroustohishealthorsafety.(b)Accidentpreventionresponsibilities.(1)Itshallbetheresponsibilityoftheemployertoinitiateandmaintainsuchprogramsasmaybenecessarytocom-plywiththispart.(2)Suchprogramsshallprovideforfrequentandregularinspectionsofthejobsites,materials,andequipmenttobemadebycompetentpersonsdes-ignatedbytheemployers.(3)Theuseofanymachinery,tool,material,orequipmentwhichisnotincompliancewithanyapplicablere-quirementofthispartisprohibited.Suchmachine,tool,material,orequip-mentshalleitherbeidentifiedasun-safebytaggingorlockingthecontrolstorendertheminoperableorshallbephysicallyremovedfromitsplaceofoperation.(4)Theemployershallpermitonlythoseemployeesqualifiedbytrainingorexperiencetooperateequipmentandmachinery.(c)Thestandardscontainedinthispartshallapplywithrespecttoem-ploymentsperformedinaworkplaceinaState,theDistrictofColumbia,theCommonwealthofPuertoRico,theVirginIslands,AmericanSamoa,Guam,TrustTerritoryofthePacificIslands,WakeIsland,OuterConti-nentalShelflandsdefinedintheOuterContinentalShelfLandsAct,JohnstonIsland,andtheCanalZone.(d)(1)Ifaparticularstandardisspe-cificallyapplicabletoacondition,practice,means,method,operation,orprocess,itshallprevailoveranydif-ferentgeneralstandardwhichmightotherwisebeapplicabletothesamecondition,practice,means,method,op-eration,orprocess.(2)Ontheotherhand,anystandardshallapplyaccordingtoitstermstoanyemploymentandplaceofemploy-mentinanyindustry,eventhoughpar-ticularstandardsarealsoprescribedfortheindustrytotheextentthatnoneofsuchparticularstandardsap-plies.(e)Intheeventastandardprotectsonitsfaceaclassofpersonslargerthanemployees,thestandardshallbeapplicableunderthispartonlytoem-ployeesandtheiremp...
