[PUBLISHEDINTHEGAZETTEOFINDIA,EXTRAORDINARY,PARTII,SECTION3,SUB-SECTION(i)]GOVERNMENTOFINDIAMINISTRYOFENVIRONMENT,FORESTANDCLIMATECHANGENOTIFICATIONNewDelhi,the04thApril,2016G.S.RNo.395(E).-Whereasthedraftrules,namelytheHazardousAndOtherWastes(ManagementandTransboundaryMovement)Rules,2015,werepublishedbytheGovernmentofIndiaintheMinistryofEnvironment,ForestandClimateChangevidenumberG.S.R.582(E),datedthe24thJuly,2015intheGazetteofIndia,ExtraordinaryPartII,section3,sub-section(ii)invitingobjectionsandsuggestionsfromallpersonslikelytobeaffectedthereby,beforetheexpiryoftheperiodofsixtydaysfromthedateonwhichcopiesoftheGazettecontainingthesaidnotificationweremadeavailabletothepublic;ANDWHEREASthecopiesofthesaidGazettecontainingthesaidnotificationweremadeavailabletothepubliconthe24thdayofJuly,2015;ANDWHEREAStheobjectionsandsuggestionsreceivedwithinthespecifiedperiodfromthepublicinrespectofthesaiddraftruleshavebeendulyconsideredbytheCentralGovernment;NOW,THEREFORE,inexerciseofthepowersconferredbysections6,8and25oftheEnvironment(Protection)Act,1986(29of1986),andinsupersessionoftheHazardousWastes(Management,HandlingandTransboundaryMovement)Rules,2008,exceptasrespectsthingsdoneoromittedtobedonebeforesuchsupersession,theCentralGovernmentherebymakesthefollowingrules,namely:-CHAPTERIPRELIMINARY1.Shorttitleandcommencement.-(1)TheserulesmaybecalledtheHazardousandOtherWastes(ManagementandTransboundaryMovement)Rules,2016.(2)TheyshallcomeintoforceonthedateoftheirpublicationintheOfficialGazette.2.Application.-TheserulesshallapplytothemanagementofhazardousandotherwastesasspecifiedintheSchedulestotheserulesbutshallnotapplyto-(a)waste-waterandexhaustgasesascoveredundertheprovisionsoftheWater(PreventionandControlofPollution)Act,1974(6of1974)andtheAir(PreventionandControlofPollution)Act,1981(14of1981)andtherulesmadethereunderandasamendedfromtimetotime;(b)wastesarisingoutoftheoperationfromshipsbeyondfivekilometresoftherelevantbaselineascoveredundertheprovisionsoftheMerchantShippingAct,1958(44of1958)andtherulesmadethereunderandasamendedfromtimetotime;1(c)radio-activewastesascoveredundertheprovisionsoftheAtomicEnergyAct,1962(33of1962)andtherulesmadethereunderandasamendedfromtimetotime;(d)bio-medicalwastescoveredundertheBio-MedicalWastes(ManagementandHandling)Rules,1998madeundertheActandasamendedfromtimetotime;and(e)wastescoveredundertheMunicipalSolidWastes(ManagementandHandling)Rules,2000madeundertheActandasamendedfromtimetotime.3.Definitions.-(1)Intheserules,unlessthecontextotherwiserequires,-1.“Act”meanstheEnvironment(Protection)Act,1986(29of1986);2.“actualuser”meansanoccupierwhoprocuresandprocesseshazardousandotherwasteforreuse,recycling,recovery,pre-processing,utilisationincludingco-processing;3.“authorisation”meanspermissionforgeneration,handling,collection,reception,treatment,transport,storage,reuse,recycling,recovery,pre-processing,utilisationincludingco-processinganddisposalofhazardouswastesgrantedundersub-rule(2)ofrule6;4.“BaselConvention”meanstheUnitedNationsEnvironmentProgrammeConventionontheControlofTransboundaryMovementofHazardousWastesandtheirDisposal;5.“captivetreatment,storageanddisposalfacility”meansafacilitydevelopedwithinthepremisesofanoccupierfortreatment,storageanddisposalofwastesgeneratedduringmanufacture,processing,treatment,package,storage,transportation,use,collec...
