SouthCarolinaDepartmentofLabor,LicensingandRegulationDivisionofLaborOfficeofOccupationalSafetyandHealthColumbia,SouthCarolina29211OSHProgramDirectiveNumber75-1910.109-1Subject:ProposedStandardsModificationstoExplosivesandBlastingAgents.Standard:ArticleVI,Section1910.109,RulesandRegulations,CommissionerofLabor,StateofSouthCarolina.CrossReferencetoFederalStandards:29CFR1910.109.Background:ToprovideadditionaladvisoryinformationandguidanceonproposedfuturechangestoSection1910.109.Questionshavearisenconcerningstandardspromulgatedinfederalstandard29CFR1910.109,ExplosivesandBlastingAgents.Conflictswithotherfederalagencies’explosivesregulationshavebeennoted.FederalOSHAwillbeattemptingtoresolvethesedifferences.Inaddition,clarificationhasbeensoughtontherequirementspecifiedinsubdivision29CFR1910.109(e)(1)(v)thatallblastingoperationsshallbeconductedduringdaylighthours.ThelatesteditionofNFPANo.495,thesourceforfederalstandard29CFR1910.109casesthisrequirementtoreflecttheunusualconditionswhichnecessitateblastingatothertimes.Interpretation:Inviewoftheseproblemareasinfederalstandard29CFR1910.109,FederalOSHAwillproposetorevisetheentiresection.TheyplantoincorporatetherelevantrevisionsoftheNFPAcodes;resolve,wherepossible,majorconflictswithotherfederalagenciesandmodifytheir“useofexplosives”paragraph.Changessuchasthefollowingwillbeproposed.(a)Thesimultaneoustransportationofblastingcapswithotherexplosivesonthesamevehiclewillbepermittedundercertainconditions.ThisispresentlyallowedbytheU.S.DepartmentofTransportationintheirstandard49CFR177.835(g).FederalOSHAwillstriveforsimilarstandards.(b)Majordifferencesbetweenexplosivesstorageregulationsin29CFR1910.109(c)andthoseoftheAlcohol,Tobacco,andFirearmsDivision,InternalRevenueService,specifiedin27CFRPart181,arebeingstudiedbyFederalOSHA.TheyplantouseAlcohol,Tobacco,andFirearms’format(fivetypesofstoragefacilitiesforexplosives)withequivalentconstructionrequirements.PresentomissionsinFederalStandards29CFR1910.109(c)suchasunbarricadeddistancesinTableH-21,willberemedied.(c)Thescopeoffederalstandard29CFR1910.109willbeclarifiedtoapplyonlytocommercialexplosives.Itwillnotapplytothemanufactureandstorageofbombs,projectiles,orotherencasedexplosivesusedinordnance.(d)SeismographicgeophysicalsurveysforgasandoilexplorationinvolvingexplosivesandblastingwillbecoveredunderOSHAConstructionStandards29CFR1926.(e)Blastingwillbepermittedattimesotherthanduringdaylighthours,forunusualoperations.Operationsforblastingslagpocketsanddustcatcherswillfallwithinthiscategoryandwillbepermittedatnightwhereproperilluminationisprovidedandotherappropriaterequirementsaremet.(f)Allsurfaceblastingoperationsshallbeperformedduringdaylighthours.(g)Unusualblastingassociatedwithindustrialprocessesthatareperformedinsidebuildingshallbepermittedregardlessoftimeofdayifbothofthefollowingconditionsaremet:1.Allrequirementsconcerningtheuseofexplosivesduringnormalblastingoperationsareimplemented.2.Aminimumilluminationdensityof20footcandlesisprovidedwithinafive(5)footradiusofwhereexplosivechargesarebeingassembled,whereexplosivechargesarebeingplaced,andwhereexplosivematerialsarebeingattachedtoinitiatingdevices.Pendingfinalapprovaloftheproposedchangesinthefederalstandards,anyviolationofarequirementofArticleVI,Section1910.109whichisinconsistentwithregulationspromulgatedbytheU.S.DepartmentofTransportationStandardorAlcohol,Tobacco,andFirearmsDivision,InternalRevenueServiceasdiscussedaboveshallbecitedasademinimisnotice,providedthattheemployerisincompliancewiththerelevantregulationsoftheseagencies.EffectiveDate:Thisinstructioniseffectiveuponreceiptandwillremainineffectuntilcancelledorsupersededbyamendmenttotheregulationorprogramdirective.WilliamM.Lybrand,DirectorSeptember25,1975
